Mountaineers Gear Library Cardholder Contract and Release of Liability

Gear Library Mission

The Mountaineers is deeply committed to helping folks explore, learn about, and enjoy the Pacific Northwest. We know that not having the appropriate outdoor gear can prevent people from exploring the natural riches our state has to offer. Our goal is to provide affordable, high-quality gear so that everyone has the opportunity to connect to nature, build outdoor skills, and reap the benefits of being outside while limiting the consumer impact on our Earth.

Expectations of The Mountaineers’ Gear Library

We will communicate with you in a timely and respectful manner about your gear request. We will provide high-quality functioning gear. We are committed to an inclusive outdoor community and welcome feedback on all of our processes.

Expectations of Gear Library Cardholders

This gear belongs to the community. When borrowing gear, it is expected that you (“Borrower”) and all others in your group will treat the gear respectfully and follow all the guidelines provided here, as well as in the orientation. Treat the gear as you would want someone else to treat your gear and return it ready for the next person.

Gear Requests/Gear Pick-Up

Only members 16 years or older who have attended a gear library orientation or are the family member of someone who has attended an orientation are allowed to pick-up gear.
Please arrive on time for pick-up and drop-off. Late arrivals or last minute requests for gear hamper our ability to serve other members and youth groups. Mountaineers staff reserve the right to cancel your gear reservation request if the scheduled pick-up time isn’t honored.

Gear Use

You are solely and wholly responsible for the gear while it is in your possession. You are responsible for any damages to the equipment beyond normal wear and tear expected from reasonable use.

The Mountaineers assume no responsibility for any injury arising from the use of the gear and Borrower and others in your group agree to release, hold harmless and indemnify The Mountaineers from any and all issues or injury arising from the gear’s use.

Gear Return

Please arrive on time for your gear return. Communicate with us via phone or email as soon as possible if this presents an issue. That same gear might be headed out with someone else very soon.

The same borrower or a family member, if in a family membership, must return the gear.
Return gear in the same state you received it, following all directions about how to prep gear for return. At a minimum, all gear should be dry and shaken out.
Report any damage or problems with the gear so we can ensure the same issue doesn’t happen for our next user.

Leave with an invoice for ALL lost or damaged gear.

Assumption of Risks, Release of Liability, Waiver of Claims, and Indemnity

By consenting to this agreement you waive certain legal rights including the right to sue. Please read carefully.

I am borrowing gear from The Mountaineers Gear Library for personal recreation use. The specific gear I am borrowing is identified at the time of gear issues and herein incorporated by reference. I accept the gear “as is” and understand it is my sole responsibility to know how to property use any gear that I borrow.

I understand it is my responsibility to pick up the gear, take care of it while I am using it, and return it to the same location and in the same condition at the end of my borrowing period as it has been defined previously by both parties.

I understand that there are inherent, and other, risks involved in the activities for which this equipment is to be used. I freely assume those risks including the risk of serious injury or death. I will use the gear in the proper manner.

I accept full financial responsibility for all the issued gear while it is in my possession. I agree to abide by the gear care guidelines provided to me, both with this contract and any information provided during gear check-out. In the event that the gear is lost or destroyed during my borrowing period, beyond normal wear and tear due to authorized use, I agree to cover the cost of the gear replacement at my own expense. I understand that The Mountaineers will charge me with the replacement cost(s) as outlined in the price list accompanying this contract. The Mountaineers retain complete and sole discretion in determining whether and to what degree equipment has been damaged and/or destroyed.

I understand that The Mountaineers is not warranting that the gear is fit for use or for any particular person. I understand that The Mountaineers performs routine maintenance on the gear but that The Mountaineers cannot and does not warrant its condition and safety at the time it is issued to me. I understand that if I routinely mistreat the gear or am disrespectful of the Gear Library’s policy, The Mountaineers reserve the right to revoke my membership.

I HEREBY RELEASE FROM LIABILITY AND AGREE TO INDEMNIFY AND HOLD HARMLESS THE MOUNTAINEERS AND ANY OF ITS EMPLOYEES, AGENTS, MEMBERS OR VOLUNTEERS REPRESENTING OR RELATED TO THE MOUNTAINEERS FOR ANY LIABILITY IN CONNECTION WITH THE USE OR POSSESSION OF THE GEAR. THIS RELEASE IS FOR ANY AND ALL LIABILITY FOR PERSONAL INJURIES (INCLUDING DEATH) AND PROPERTY LOSSES OR DAMAGES OCCASIONED BY, OR IN CONNECTION WITH THE POSSESSION OR USE OF THE GEAR.

This release shall be binding to fullest extent permitted by law. This release shall be binding upon the assignees, subrogees, distributors, heirs, next of kin, executors, and personal representatives of the Borrower. I have read this RELEASE AND INDEMNITY AGREEMENT and have fully informed myself of its contents before I have signed it.

If Borrower is under 18 years of age, I verify that I am the parent or legal guardian of the minor named above and I have the authority to enter into an agreement on behalf of the gear borrower and I agree to be bound by the terms and conditions of this agreement.
