All students must submit this form for ICOPro, the parent organization for this course

introduction

The Mountaineers is offering this Waterfall Canyoneering course in partnership with ICOPro, the International Canyoning Organization for Professionals. All students must complete this form before registering for the course. The form will be submitted to the ICOPro representative, and a copy will be sent to you and to Mountaineers staff.

Contract and Cancellation policies

E-learning Pass and ICTC/PACK

1.1 The Trainee must read, sign and send back to the organizer this participant record before paying any fee to the organizer and before starting the E- learning.

  • If the Trainee signs this document after starting their E-learning or pays any deposit to the Organizer, he has the right to cancel the training course and the Organizer will reimburse 100% of non-refundable expenses, related to the training course (flight ticket, visa, etc) regardless of the number of days before the training
  • The Trainee will receive an E-learning pass by the Organizer to access the compulsory, pre-course E-learning, and after the Trainee must pay the cost of the training course (or 50% minimum).
  • This E-learning will be active from 30 days before the start of the training course, and will be inactive the day of the start of the training
  • If the Trainee does not receive an E-learning pass by the Organizer, they have the right to request it from: support@icopro.org between 7 to 30 days before starting the course, and will pay the fee directly to
  • The Trainee will not able to participate in the course if they do not successfully pass the Multi-choice questionnaire
  • The Trainee must pay 100% of the course fees no later than 1 month before the start of the training course.
  • Included with the E-learning PASS, the Trainee will receive an ICTC/PACK by the ORG at the beginning of the course which includes:
    • 1 Course Manual (latest authorized version)
    • 1 ICOpro tee-shirt
    • 3 stickers
  • At the end of the course, the Trainee will receive from the Examiner a canyoneer card and license according to the level reached by the
  • For any registration between 7 to 29 days before the start of the training course, the Trainee understands and accepts the possibility of starting the training course without receiving the PACK on
  • The ORG will print the necessary materials to do the course correctly and will send the ICTC/PACK to the trainee after the All shipping costs will be at the expense of the ORG.
  • The ORG has the right to refuse any registration between 7 to 29 days before the start of the

2  The ICTC is cancelled by the Organizer

  • 2.1  The Organizer cannot cancel a training course if there are a minimum of 3 candidates.

  • 2.2  In case there are not enough candidates (less than 3) to run the ICTC, the Organizer will

    inform the candidates:

  • 2.3  0 to 30 days prior to the course, The Organizer will:

    • 2.3.1  Reimburse the deposits paid by the candidates (except the E-learning pass and ICTC/PACK cost). The Trainee will have no limit on time to find another Center to do their Training course.

    • 2.3.2  Send back the ICTC/PACK to ICOpro and reimburse the shipping cost, or send the PACK to the other Center chosen by the Trainee for their new training course.

    • 2.3.3  Reimburse the Canyoneer card (license) of the Trainee, and shipping cost to ICOpro, to allow ICOpro to create a new one according to the other training course chosen by the Trainee

    • 2.3.4  Reimburse the flight ticket of the trainee if it was paid between 0 and 30 days before starting the course.

    • 2.3.5  Reimburse other non-refundable expenses incurred by the Trainee related to the training course (visa...), if the expense was paid between 0 and 30 days before starting the course.

  • 2.4  31 days or more prior to the course, The Organizer will:

    • 2.4.1  Reimburse the deposits paid by the candidates

    • 2.4.2  The E-learning pass will not be activated.

3 The ICTC is cancelled by the Examiner (exa)

  • 3.1  An Examiner can cancel a course in case of emergency only or in case of force majeure. Provided:

  • 3.2  The EXA will be replaced by another EXA.

  • 3.3  If no other EXA can replace the EXA who cancelled the course and if the course cannot be postponed, the Organizer will apply the same rules as Article 2.

  • 3.4  If Article 3.3 is applied, all reimbursements will be incurred by the EXA who cancelled the course.

4 Cancellation by a candidate

  • 4.1  The candidates can cancel the course at any time and receive 100% reimbursement of all fees if the ORG requests a deposit of courses fees without having had the candidate sign the Participant record prior to the course.

  • 4.2  If there is a cancellation by the Candidate between 0 to 30 days prior to the course,

    • 4.2.1  The Organizer will not reimburse the deposits already paid by the candidate.

    • 4.2.2  The E-learning Pass will be disable

    • 4.2.3  The ICTC/PACK will become the Center’s property

  • 4.3  If there is a cancellation by the candidate 31 days or more prior to the course,

    • 4.3.1  The Organizer will reimburse the candidate’s deposit, after deducting 7% of the administrative fees of the total amount of the training course;

    • 4.3.2  The Candidate will incur the bank charges and the change fees.

5. cancellation due to weather conditions

  • 5.1 The Candidates are aware that they might not be certified at the end of the ICTC if the weather does not permit technical practice in a canyon and/or the final technical test. In order to respond favorably to this type of situation:
  • 5.1.1  The EXA is allowed to move forward the theoretical days if the weather will be bad for the practice;

  • 5.1.2  The technical courses will be performed elsewhere, such as cliffs or other adapted places (indoors);

  • 5.1.3  One or two days will be added to the ICTC if the EXA, Organizer and Candidates come to an agreement;

  • 5.1.4  If the ICTC cannot be postponed, and if the final tests in the canyon cannot be taken, the EXA will not be allowed to validate the trainees. He will give them a shadowing form to take their test in another ICOpro Affiliated Center under supervision of an Instructor level 3 minimum.

  • 5.1.5  The fees of this shadowing day will be charged to the Trainee.

release, waiver and assumption of risk agreement

In consideration of receiving instruction in the sport of CANYONING, the undersigned participant (and the parent or legal guardian of participant if participant is a minor), for themselves, their personal representatives, heirs, executors, next of kin, spouses, minor children and assigns, do agree as follows:
A. DEFINITIONSThe following definitions apply to terms used in this Agreement:

1. “CANYONING” involves walking down a narrow deep cleft carved or not in a wild environment, scrambling your way up and down a dry or wet river bed where you may enjoy waterfall abseiling, walking, wading, floating, climbing, jumping, abseiling with ropes. Canyoning involves trekking in wild environment as well, and any other improvised free-movement as you progress if necessary. The listing of examples in this definition is not meant to limit, in any way, the scope of the definition of CANYONING. 2. “PARTICIPATION IN THE SPORT” means engaging in the sport of CANYONING and includes all activities involving the setup, use and preparation of CANYONING equipment, and further includes the giving or receiving of assistance or instruction in the sport of CANYONING.

3. “SPORT INJURIES” means personal injury, bodily injury, death, property damage and/or any other personal or financial injury sustained by participant as a result of PARTICIPATION IN THE SPORT and/or as a result of the administration of any ICOPRO program (for example: the certification program).
4. “RELEASED PARTIES” means the following, including: the owners, officers, directors, agents, spouses, employees, officials (elected or otherwise), members, representatives, examiners, trainers, certified instructors, certified schools, independent contractors, sub-contractors, lessors and lessees:

a) ICOPRO– Extreme outdoor sports company Worldwide;
b) Each of the person(s) sponsoring and/or participating in the administration of participant’s
ICOPRO certification(s);
c) Each of the CANYONING organizations that are affiliated in any way with
ICOPRO, such as other companies, schools, clubs and/or non-profits, etc...;
d) Each of the property owners on or over whose property participant may participate in the sport;
e) All persons involved, in any manner, in the sports of CANYONING at the site(s) where participant PARTICIPATES IN THE SPORT. «All persons involved» include, but are not limited to spectators, canyoneers, assistants, centers, instructors, observers, trainers, examiners and the owners of any involved equipment, etc...;
f) All other persons lawfully present at the site(s) during participant’s PARTICIPATION IN THE SPORT;
B. I FOREVER RELEASE AND DISCHARGE THE RELEASED PARTIES FROM ANY AND ALL LIABILITIES, CLAIMS, DEMANDS, COMPENSATION, OR CAUSES OF ACTION THAT I MAY HEREAFTER HAVE FOR SPORTS INJURIES, CAUSED IN WHOLE OR PART BY THE ACTION, INACTION OR NEGLIGENCE (WHETHER ACTIVE OR PASSIVE) OF ANY OF THE RELEASED PARTIES, TO THE FULLEST EXTENT ALLOWED BY LAW.
C I WILL NOT SUE OR MAKE A CLAIM
against any of the RELEASED PARTIES for loss or damage on account of SPORTS INJURIES. If I violate this agreement by filing such a suit or making such a claim, I will pay all attorney’s fees and costs of the RELEASED PARTIES.
D. BREACH OF AGREEMENT. If any part, article, paragraph, sentence or clause of this Agreement is not enforceable, the affected provision shall be curtailed and limited only to the extent necessary to bring it within the requirements of the law, and the remainder of the Agreement shall continue in full force and effect.
E. CONSTRUCTION. This agreement shall apply to any and all SPORTS INJURIES occurring at any time after the execution of this agreement. This agreement is in addition to and is not intended to replace any other agreements related to liability for SPORTS INJURIES that participant (participant's parents or legal guardians) may have signed, either in the past or in the future. To the extent that there is any conflict between such agreements, participant (participant's parents or legal guardians) intends to be subject to the agreement that provides the most expansive release of claims and assumption of risk allowed by law.
F. I VOLUNTARILY ASSUME ALL RISKS, KNOWN AND UNKNOWN, OF SPORTS INJURIES, HOWEVER CAUSED, EVEN IF CAUSED IN WHOLE OR IN PART BY THE ACTION, INACTION, OR NEGLIGENCE (WHETHER PASSIVE OR ACTIVE) OF THE RELEASED PARTIES, TO THE FULLEST EXTENT ALLOWED BY LAW. I HAVE READ THIS AGREEMENT; I FULLY UNDERSTAND THE POTENTIAL DANGERS OF ENGAGING IN CANYONING AND THAT ACTION, INACTION OR NEGLIGENCE OF OTHERS CAN INCREASE THOSE DANGERS; I FURTHER UNDERSTAND AND AGREE THAT THIS DOCUMENT IS LEGALLY BINDING AND WILL PREVENT ME FROM RECOVERING MONETARY DAMAGES FROM THE ABOVE LISTED ENTITIES AND/OR INDIVIDUALS, WHETHER SPECIFICALLY NAMED OR NOT, FOR PERSONAL INJURY, BODILY INJURY, PROPERTY DAMAGE, WRONGFUL DEATH, OR ANY OTHER PERSONAL OR FINANCIAL INJURY SUSTAINED IN CONNECTION WITH PARTICIPANT’S PARTICIPATION IN THE SPORT.
WARNING: BY SIGNING, YOU ARE WAIVING SIGNIFICANT LEGAL RIGHTS. DO NOT SIGN WITHOUT READING!

Insurance

I am aware that the Organizer of the ICOPRO training course has subscribed to a professional insurance for the candidates.

I am informed that the above named insurance does not cover 100% of the costs related to incidents, accidents, minor or major but at least will cover me up to the limit of this insurance policy’s subscription.

I further state I have carefully read and fully understood the terms contained in the enclosed policy’s copy and I do hereby release and discharge the Organizer center of ICOPRO training course and ICOPRO Company, their trustees, its officers, and/or officials, employees, volunteers and agents from any and all claims, damages, demands, liabilities in the event of hospitalization, medical repatriation or any extra fees that could be higher than the maximum amount authorized by the Organizers’ center insurance policy. I agree to pay the total extra fees superior to the reimbursement maximum amount of the insurance policy of the Organizer center in charge of the training course.

Do not sign this document without reading the copy of the center’s insurance certificate and without being assured that it is valid during your training course.
